1.7 User Data and Technical Information

When visiting this website, general technical information is collected. These include the IP address used, time, length of visit, browser type and, if necessary, the site of origin. These user data are registered in a log file due to technical conditions and can be used and stored for statistical purposes of this website. Additional personal data are not linked to this user data unless you provide such information.

1.8 Data Retention and Deletion

Your personal information will not be kept longer than is necessary for the specific purpose for which it was collected.

When we decide how long we will keep your information we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, why we need it, and any relevant legal requirements (such as legal retention and destruction periods, especially tax and accounting regulations which may require retention for up to 10 years).

The foregoing will, however, not prevent us from retaining any personal information if it is necessary to comply with our legal obligations, in order to file a legal claim or defend ourselves against a legal claim, or for evidential purposes.

1.9 International Transfers

The processing of your personal data takes place within the EU/EEA where possible. However, some of our service providers are located outside the EU/EEA, including in the United States.

When we transfer personal information to countries outside of the EU/EEA, we ensure that appropriate safeguards are in place, such as:

  • Standard Contractual Clauses (SCCs) approved by the European Commission
  • Adequacy decisions by the European Commission confirming adequate data protection levels
  • Additional technical and organizational measures to protect your data

For transfers to the United States, we ensure our service providers have implemented appropriate safeguards following the invalidation of Privacy Shield. We conduct transfer impact assessments and implement supplementary measures where necessary to ensure adequate protection of your data.

Given the nature and scope of our processing activities, we have not appointed a formal Data Protection Officer as we do not meet the threshold requirements under Article 37 GDPR. You have the right to demand from us that we immediately delete your personal data referring to you. We are required to delete them immediately, especially for one of the following reasons:

  • You revoke your permission which was the basis for processing your data, and no other legal basis for the processing exists
  • You object to the processing and there are no overriding legitimate grounds for processing

2.5 Right to Data Portability

You have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format, and you have the right to transmit those data to another controller without hindrance from us, where:

  • The processing is based on consent or a contract
  • The processing is carried out by automated means

You have the right to object at any time to processing of your personal data which is based on legitimate interests (Article 6(1)(f) GDPR), including profiling based on those provisions.

You also have the right to object at any time to processing of your personal data for direct marketing purposes, including profiling related to such marketing.

As far as the processing of your personal data is based on consent, you have the right to withdraw this consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

6.1 Google Analytics

This website uses Google Analytics, a web analysis service operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

What Data is Collected: Google Analytics uses cookies to analyze your use of the website. Information generated by the cookie about your website use (including your IP address) is transmitted to and stored by Google.

We use web fonts from Google (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland) to show you a consistent font on our website. These are automatically loaded when you call up one of our pages to enable the desired display.

When you access our pages, a connection to Google servers is established. Google may record that your IP address has accessed our website.

6.5 Use of Google reCAPTCHA

We use "Google reCAPTCHA" on our websites (provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland).

Purpose: reCAPTCHA is used to check whether data entered on our website (such as on a contact form) has been entered by a human or by an automated program, protecting our site from spam and abuse.

How it Works: reCAPTCHA analyzes the behavior of the website visitor based on various characteristics (e.g., IP address, time spent on website, mouse movements). This analysis starts automatically as soon as the website visitor enters the website. The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses take place completely in the background. Website visitors are not explicitly advised that such an analysis is taking place.

6.6 Use of Meta (Facebook) Pixel

We use the "visitor action pixels" from Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Meta/Facebook") on our website.

Purpose: This allows user behavior to be tracked after they have been redirected to our website by clicking on a Facebook ad. This enables us to measure the effectiveness of Facebook ads for statistical and market research purposes.

6.7 Login with Facebook Account

What Data is Processed: After accepting the cookie policy, CrossEngage analyzes and processes web visits and user behavior on this website as well as all other relevant Borrow A Boat data sources.

6.10 WhatsApp Communication

If WhatsApp is used as a communication channel, personal data is processed by WhatsApp LLC (a Meta company, 1601 Willow Road, Menlo Park, California 94025, USA, or Meta Platforms Ireland Limited for EU users).

Important: WhatsApp is not a contractual partner of Borrow A Boat. Therefore, data processing for the transmission procedure takes place exclusively in accordance with the WhatsApp data protection declaration, which can be viewed in the WhatsApp user account or at https://www.whatsapp.com/legal/privacy-policy

Data Processing: WhatsApp may process personal data outside the EU, which may not have a comparable level of data protection to the EU. WhatsApp has implemented Standard Contractual Clauses and additional safeguards to ensure data security.

End-to-End Encryption: WhatsApp messages are equipped with end-to-end encryption which, according to WhatsApp, prevents the content of a message (e.g., a passport photo) from being viewed or evaluated by unauthorized parties.

Your Choice: Before using WhatsApp, you should read the data protection statement. If you do not agree with WhatsApp's data processing, you should not use it but rather call or email us using the contact details in Section 7.

When you opt-in to our SMS service, we will send you a message to confirm your signup. By opting into messages, you agree to receive recurring automated marketing and informational text messages from Borrow A Boat. Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.

Message Frequency and Costs

Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with Borrow A Boat. We reserve the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. We also reserve the right to change the short code, phone number, or alphanumeric sender from which messages are sent.

Your usual message and data rates may apply. If you have any questions about your text plan or data plan, contact your mobile provider. Your mobile provider is not liable for delayed or undelivered messages.

Data Collected

When you sign up for SMS services, we collect:

Transfer of Mobile Number

If you change your mobile number or transfer it to another individual, you must:

  • Reply "STOP" from the original number before the transfer, or

Failure to inform us may result in messages being sent to the new holder of your former number. This duty to inform us is a condition of using our SMS service.

Carriers and Delivery

Mobile carriers are not liable for delayed or undelivered messages. Message delivery depends on factors outside our control, including your mobile carrier's network and your device's capabilities.

Data Retention for SMS
